Summary: The complainant requested information relating to an internal investigation into the death of an in-patient of the public authority. Some information was disclosed, but other information was refused under the exemption at section 41(1) of the Freedom of Information Act, on the grounds that it was given in confidence. The Commissioner has examined the withheld information and finds that the information was correctly withheld under the exemption provided at section 41(1) of the Act. He does not require any action to be taken. This decision notice is currently under appeal to the Information Tribunal.
