Summary: The complainant requested certain information relating to the 2010 valuation rating list for non-domestic properties. The public authority withheld the disputed information on the basis of section 44(1)(a) of the Act (statutory prohibition on disclosure). The Commissioner found that section 44(1)(a) was correctly applied to withhold the disputed information. The Commissioner however found that the public authority did not hold information relevant to parts of the request and should have made this clear to the complainant at the time of the request. He therefore found the public authority in procedural breach of the Act in relation to this.
