Dorset Police (Decision Notice) [2012] UKICO FS50433957 (12 July 2012)

Summary: The complainant requested information on the costs involved with the -Driver Awareness Scheme- operated by Dorset Police (-the Constabulary-). The Constabulary initially refused the request by relying on section 12(1) of the FOIA and stated that the cost of complying with the request would exceed the appropriate limit as set out in the Freedom of Information and Data Protection (Appropriate Limit and Fees) Regulations 2004. In its internal review the Constabulary revised its response and refused to comply with the request because it considered it to be vexatious under section 14(1) of the FOIA. The Commissioner-s decision is that the Constabulary correctly determined the request to be vexatious. There are no steps to be taken. Information Tribunal appeal number EA/2012/0163 dismissed.
