Summary: The complainant has requested a copy of the Deloitte review of Derby Hospitals NHS Foundation Trust-s (-the Trust-) finances. The Trust initially refused to provide this information on the basis of the section 43 (commercial interests exemption). However, the Trust later sought to withhold the requested information on the basis of section 36(2). The Commissioner-s decision is that section 36 is engaged and, after considering the public interest arguments, the Trust has correctly withheld the information.
