Cheshire East Council (Decision Notice) [2013] UKICO FER0479092 (07 May 2013)

Summary: The complainant has requested information relating to the proposed development of Macclesfield town centre and terms of Cheshire East Council-s (the -council-) contract with the developer, Wilson Bowden. The council provided the complainant with some information but withheld much of the information under the exceptions for internal communications, the course of justice and the confidentiality of commercial information. The Commissioner-s decision is that the council has wrongly applied the exception for the confidentiality of commercial information and that, whilst the exception for the course of justice is engaged in relation to some of the information, the public interest favours disclosing the information. This decision notice is currently under appeal to the Information Tribunal.
