Summary: The complainant made a request for information through his solicitors for information concerning trading standards investigations conducted by Luton Borough Council (the council) which were similar to the investigation the council conducted into his business. The council refused to provide the requested information stating it was exempt from disclosure under section 44 of the FOIA as it was prohibited from disclosure under section 237 of the Enterprise Act 2002. The Commissioner-™s decision is that the council has correctly applied the exemption to the requested information. The Commissioner does not require the council to take any steps.
