Summary: The complainant has requested information relating to a complaint they made to North Lincolnshire Council (the -council-) about a Councillor. The council refused the request citing the exemption for investigations and proceedings conducted by public authorities (section 30(2) of the FOIA). The Commissioner-s decision is that North Lincolnshire Council has failed to demonstrate that the withheld information engages the exemption at section 30(2) of the FOIA but that the information is exempt under the exemption for third party personal data, namely section 40(2) of the FOIA. The Commissioner does not require the public authority to take any steps.
