Summary: The complainant has requested information from the Environment Agency relating to coastal erosion. The Environment Agency provided information in response to some parts of the complainant-™s request but refused to disclose information in relation to other parts, applying regulation 12(4)(b) (manifestly unreasonable) of the EIR as a basis for non-disclosure. The Commissioner considers that the Environment Agency has correctly applied regulation 12(4)(b) to the relevant parts of the complainant-™s request, however it has breached regulation 5(2) by providing the information outside the statutory time limit. The Commissioner requires no steps to be taken.
