The complainants submitted a request to Kirklees Council (the Council) for information it held about complaints they had made about the excessive noise of exercise classes at a particular sports centre. The Council provided some information and initially sought to withhold the remainder under regulations 12(4)(d) and 12(4)(e) of the EIR. During the course of the Commissioner’s investigation, the Council reviewed its position and provided the complainants with the information it had initially sought to withhold. In doing so, it accepted the Commissioner’s view that some of this information was the complainants’ own personal data. The complainants remained concerned that the Council held further information falling within the scope of their request. The Commissioner is satisfied that the Council does not hold any further information.
