The complainant made a request to the Marine Management Organisation (“MMO”) for information related to the issuing of licence variations for fishing vessels. The MMO disclosed some information in respect of parts of the request and applied the exception in regulation 12(4)(a) (information not held) in respect of other parts. The complainant queries whether regulation 12(4)(a) had been correctly applied. The Commissioner’s decision is that the MMO has correctly applied the exception in regulation 12(4)(a) to the relevant parts of the request. However, he has determined that it breached regulation 14(2) by not providing a refusal citing the regulation 12(4)(a) within 20 working days of receipt of the request. He does not require the MMO to take any further steps to ensure compliance with the legislation.
