The complainant has requested a viability assessment relating to a proposed housing development. North West Leicestershire District Council refused the request citing the exception for adverse affect to the confidentiality of commercial information (regulation 12(5)(e) of the EIR). The Commissioner’s decision is that North West Leicestershire District Council has correctly applied regulation 12(5)(e) to the requested information and that the public interest favours maintaining the exception. The Commissioner does not require the public authority to take any steps.
