The complainant has requested information about the departure of a senior officer from Wirral Metropolitan Borough Council (“the council”). The council disclosed some information, but withheld the remainder under the exemption provided by section 40(2) of the Freedom of Information Act (“the FOIA”). The Commissioner’s decision is that the council has correctly withheld the information under section 40(2), but has breached the requirement of section 10(1) by failing to respond to the request within 20 working days. The Commissioner does not require any steps to be taken.
