The complainant has requested information relating to a planning appeal. The council refused to provide some information on the grounds that Regulations 13(1), 5(3), 12(5(b), 12(4)(e) and 12(4)(d) applied. The council subsequently withdrew its reliance on Regulation 12(4)(d) and applied Regulation 13(1) to that information in its place. The Commissioner’s decision is that the council has correctly applied Regulations 5(3), 13(1) and 12(4)(e) to the information. However he has decided that one form should be disclosed to the complainant subject to a small number of redactions under Regulation 5(3). The Commissioner requires the public authority to disclose a copy of the letter to the council from the Planning Inspectorate informing it of the complainant's appeal, subject to the redaction of personal data belonging to the complainant under Regulation (5)(3).
