The complainant has requested figures for assessments and appeals of special educational needs in Wirral Local Authority. The Council provided exact figures where the numbers exceeded five but aggregated figures less than five on the basis that individuals could be identified and section 40(2) was therefore engaged. The Commissioner’s decision is that the Council has correctly applied section 40(2) to withhold figures less than five.
