The complainant has requested in a 14 part request from London Borough of Hammersmith & Fulham (the “Council”) information relating to residents’ parking complaints in a particular area. The Commissioner investigated the Council’s response in relation to parts 1, 2, 3, 4 and 11 to 14. It applied section 12 of the FOIA to parts 1, 2 and 3 and confirmed that it does not hold any further information to the remaining parts of the request. The Commissioner’s decision is that the Council is entitled to rely on section 12 to parts 1, 2 and 3 as a basis for refusing the request. To the remaining parts of the request, the Commissioner’s decision is that the Council does not hold any further information falling within the scope of the request. Therefore, the Council has complied with its obligations under section 1 of the FOIA. The Commissioner does not require the Council to take any steps. This decision notice is currently under appeal to the Tribunal.
