The complainant has requested copies of draft audit reports produced by the Department for Social Development. The Department initially refused the request in reliance on the exemption at section 43(2) of the FOIA. The Department subsequently revised its position and sought to rely on section 14, claiming that the request was vexatious. The Commissioner’s decision is that the Department was entitled to rely on section 14(1) of the FOIA. No steps are required.
