The complainant has requested the university to disclose information relating to Employment Tribunal claims over a three year period. The Commissioner’s decision is that in relation to questions one and two of the request, the university does not hold any further recorded information to that already provided. In relation to questions four and five, the Commissioner’s decision is that section 12 of the FOIA does not apply. The Commissioner therefore requires the university to reconsider questions four and five of the request again and issue a fresh response under FOIA without relying on section 12. The university must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
