15 July 2015, Central government
The complainant has requested information contained in the Town and Country Planning Act 1990 and the Town and Country Planning (Use Classes) Order 1987 (as amended). The Commissioner finds that the requested information is reasonably accessible to the public as it is contained in published legislation. The Commissioner has therefore decided that the Planning Inspectorate is entitled to rely on section 21 of the FOIA to refuse to provide the information to the complainant. The Commissioner does not require the Planning Inspectorate to take any further action in respect of this complaint. Information Tribunal appeal EA/2015/0168 withdrawn.
FOI 21: Not upheld
