The complainant has requested the names of witnesses and their statements in relation to a Health and Safety Executive (HSE) investigation into an incident. The HSE withheld this information on the basis of section 40(2) of the FOIA as it considered the information to be personal data. The Commissioner’s decision is that the HSE has correctly withheld this information under section 40(2) and he requires no steps to be taken.
