The complainant has requested the college to disclose which hours there is at least one member of staff on duty at the Hammersmith animal research facility. The college responded refusing to disclose the requested information under section 38 of the FOIA. The Commissioner’s decision is that the college applied section 38 of the FOIA correctly in this case and the public interest in favour of disclosure is outweighed by the public interest in maintaining this exemption. The Commissioner therefore does not require any further action to be taken.
