The complainant has requested information from the Royal Borough of Kensington and Chelsea (“the Council”) relating to the disciplinary file of an employee of the Council. The Commissioner’s decision is that the Council should have maintained its position that it was unable to confirm or deny that the requested information was held in accordance with section 40(5) of the FOIA. The Commissioner requires the Council to take no steps.
