The complainant has requested information regarding the civil liability exclusion enacted by section 69 of the Enterprise and Regulatory Reform Act 2013 and information regarding the complaint lodged by the Association of Personal Injury Lawyers (reference CHAP (2014) 01428) (Complaint by the Commission of the European Communities concerning alleged infringement of Directive 89/391/EEC in the UK and Scotland).The HSE provided some information but withheld some information under section 40(2), 42 and 44 of the FOIA. The Commissioner’s decision is that the HSE has correctly applied section 42 and 44 FOIA to the withheld information. The Commissioner requires no steps to be taken.
