The complainant submitted a request to the public authority for information relating to the authority’s assessment of the potential effect of the introduction of standardised packaging of tobacco products on the illicit tobacco market. The public authority relied on the exemptions at sections 27(1)(a), 35(1)(a) and 44(1)(a) FOIA to withhold information within the scope of the request. The Commissioner’s decision is that the public authority was entitled to rely on the exemptions at sections 27(1)(a), 35(1)(a) and 44(1)(a). No steps are required.
