The complainant has requested information about the categories NHS Improvement has segmented trusts into based on their likely trajectory towards a sustainable organisational form. NHS Improvement refused to provide the requested information under section 33(1)(b) and 43(2) FOIA. The Commissioner’s decision is that NHS Improvement has incorrectly applied section 33(1)(b) and 43(2) FOIA to the withheld information. The Commissioner requires the public authority to disclose the withheld information.
