The complainant has requested information relating to the management of Aylesbury Waterside Theatre. Aylesbury Vale District Council refused the request, citing the exemptions for information provided in confidence (section 41) and prejudice to commercial interests (section 43(2)).The Commissioner’s decision is that Aylesbury Vale District Council has incorrectly applied both the exemption for information provided in confidence at section 41 of the FOIA and the exemption where disclosure would prejudice commercial interests at section 43(2) of the FOIA. The Commissioner requires the public authority to disclose the withheld information to the complainant.
