The complainant requested information relating to an allegation of assault. The Ministry of Justice (MoJ) confirmed it held the requested information but refused to provide it, citing sections 40(2) (personal information) and 41(1) (information provided in confidence) of the FOIA. The Commissioner has investigated the MoJ’s application of section 40(2) and has concluded that the withheld information is exempt from disclosure on the basis of that exemption. The Commissioner requires no steps to be taken as a result of this decision.
