The complainant has requested information from the county council relating to correspondence and other documents with a Parish Council regarding the parish council’s plan to take over the running of a library from the County Council. The council provided some information, withheld other information under section 42 (legal professional privilege), section 41 (information provided in confidence) and section 43 (commercial interests). The complainant also questioned whether further information should have been disclosed to him. The Commissioner’s decision is that the council has correctly applied section 42 to the information. Following further information being disclosed to the complainant during her investigation she has also decided that on a balance of probabilities no further information is held by the council. She has also decided that the council failed to comply with the timescales required by section 10(1). The Commissioner does not require the council to take any steps.
