The complainant has requested an agenda for a meeting of a Passenger Advisory Group. West Sussex County Council (‘the Council’) has confirmed it holds the information but says it holds it on behalf of Gatwick Airport Consultative Committee (GATCOM). The Council says that since GATCOM is not a public authority for the purposes of the FOIA, the Council cannot be said to hold the information under section 1(1)(a) of the FOIA. The Commissioner’s decision is that the Council does not hold the requested information for the purposes of the FOIA. The Commissioner does not require the Council to take any steps.
