Surrey County Council

The complainant has requested information about a local right of way.  Surrey County Council (‘the Council’) denies holding the requested information. The Commissioner’s decision is that the Council is entitled to refuse to provide the requested information under regulation 12(4)(a) of the EIR because, on the balance of probabilities, it does not hold the information. The Commissioner does not require the public authority to take any steps.
