The Commissioner’s decision is that Historic England was entitled to rely on regulations 12(4)(e), 12(5)(d) and 12(5)(b) of the EIR. The Commissioner does not require the public authority to take any steps. Information Tribunal appeal EA/2019/0046 under appeal.
