Cumbria Constabulary

The complainant has requested from Cumbria Police information in relation to an incident when he was knocked off his pushbike by an individual subsequently investigated for drink driving. Cumbria Police cited Section 40(5)(b)(i) and said it would neither confirm nor deny whether the requested information was held. The Commissioner’s decision is that Cumbria Police has correctly applied Section 40(5)(b)(i) of the FOIA. The Commissioner therefore does not require the public authority to take any steps to ensure compliance with the legislation.
