Hastings Borough Council

The complainant asked Hastings Borough Council for the final peer review report and associated correspondence which relates to a Peer Review undertaken on the Council’s behalf by the Local Government Association. The Council confirmed that it did not intend to publish a final report but confirmed that it the report in draft format and certain other related information. The Council informed the complainant that it was withholding this information in reliance on section 36 of the FOIA. The Commissioner’s decision is that Hastings Borough Council has correctly applied the exemptions to disclosure provided by sections 36(2)(b) and 36(2)(c) of the FOIA. The Council is therefore entitled to withhold the information the complainant has asked for.
