Sandwell Metropolitan Borough Council

The complainant requested from Sandwell Metropolitan Borough Council (“the Council”) a Counter Fraud Unit report regarding the allocation of a tenancy. The Council refused to provide the report in reliance on section 40(2) of the FOIA as it considered it to be the personal data of the tenant and Council officers involved in the process. The Commissioner’s decision is that the Council has correctly cited section 40(2) of the FOIA. The Commissioner does not require the Council to take any steps.
