Winchester City Council

The complainant requested a copy of a complaint that neighbours of a property they own had made to Winchester City Council (“the Council”). The Council refused to disclose the information under regulation 13(1) of the EIR as it considered the complaint to be the neighbours’ personal data. The Commissioner’s decision is that the Council was entitled to withhold the information under regulation 13(1), by way of regulation 13(2A)(a). The Commissioner does not require the Council to take any steps.
