Redbridge London Borough Council

The complainant requested information from the London Borough of Redbridge (“the Council”) relating to the removal of items belonging to the complainant by the Council. Whilst the Council provided the complainant with some information within the scope of the request, it denied holding information which recorded the condition of the complainant’s items at the time of their removal. The Council also withheld the name of the Council staff member who removed the items citing section 40(2) (personal data) of the FOIA as its basis for doing so. The Commissioner’s decision is that the Council does not hold information which records the condition of the complainant’s items at the time of their removal. The Commissioner is also satisfied that the Council is entitled to rely on section 40(2) of the FOIA to withhold the name of the Council staff member who removed the items. The Commissioner does not require the council to take any steps.
