Westminster City Council

The complainant has requested information on business (non-residential) property rates data held by Westminster City Council (“the Council”). The Council cited section 31(1)(a) (the prevention and detection of crime), and section 41(1) (information provided in confidence) of FOIA to withhold the information. The Commissioner’s decision is that the Council was entitled to rely on the exemptions within section 31(1)(a) of FOIA to withhold the requested information, and the public intertest lies in maintaining the exemption. The Commissioner does not require the Council to take any steps.
