Datchworth Parish Council

The complainant requested from Datchworth Parish Council (the council) a copy of an email and attachments sent between the Responsible Finance Officer and the chair of the council on a specific date. The council refused the request on the basis that section 14 of FOIA applied (vexatious requests). Subsequently, it agreed to disclose the majority of the information to the complainant, making a small number of redactions under section 40(2) (personal information). The Commissioner’s decision is that the council was correct to withhold the personal data which it redacted under section 40(2) of the FOIA. The Commissioner requires the council to take the following steps to ensure compliance with the legislation. To disclose the withheld information to the complainant, subject to the redactions which the council informed the Commissioner that it intended to make under section 40(2) of FOIA.
