The complainant submitted a request to the Ministry of Defence (MOD) seeking a copy of her father’s medical record for particular period in the 1950s. The MOD confirmed that it held information falling within the scope of the request but refused to disclose this on the basis of section 41(1) (information provided in confidence) of FOIA. The Commissioner’s decision is that the MOD is entitled to refuse to disclose the information on the basis of section 41(1) of FOIA. Information Tribunal appeal EA/2023/0231 under appeal.
