Channel Four Television Corporation

The complainant requested information relating to a commercial relationship with Sainsbury’s. Channel Four Television Corporation (“Channel 4”) responded that the requested information was covered by the derogation and hence excluded from FOIA. The Commissioner’s decision is that this information was held by Channel 4 for the purposes of journalism, art or literature and so was not covered by FOIA. He therefore upholds the Channel 4’s position and requires no remedial steps to be taken in this case. Information Tribunal appeal EA/2023/0210 under appeal.
