Mid Devon District Council

The complainant submitted a request to Mid Devon District Council (the Council) for a full copy of the 3 Rivers Development Haddon Heights Viability Assessment. The Commissioner’s decision is that the Council was entitled to rely on regulation 12(5)(e) to withhold the information and that the balance of the public interest, lies in the exception being maintained. However, the Commissioner finds a breach of regulation 5(2) regarding the delay in fully responding to the request. The Commissioner does not require further steps as a result of this decision notice.
