London Borough of Havering

The complainant has requested the make and model of the CCTV enforcement camera utilised by the London Borough of Havering (the ‘Council’) at a specified location. Ultimately, the Council refused to provide the requested information, citing section 43(2) of FOIA – the exemption for commercial interests. The Commissioner’s decision is that section 43(2) of FOIA is not engaged for the reasons set out in this notice. The Commissioner requires the Council to take the following step within 35 calendar days of the date of this decision notice to ensure compliance with the legislation. • Disclose the information requested by the complainant, namely the make and model of the CCTV enforcement camera used at the specified location.
