Summary
One of the claimants (Zadorozhny) and another person (Kirk) were named as inventors on the patents in question. The claimants applied under section 13 for Kirk to be removed as an inventor and for the other claimant (Bakhir) to be added. They also applied under section 37 to seek ownership of the patents. The defendants, as proprietors of the patents, initially opposed both the reference under section 13 and the action under section 37, but subsequently dropped their opposition to the reference under section 13. Kirk filed no opposition on his own behalf. The Hearing Officer therefore concluded that Bakhir should be should be mentioned as inventor in both patents, and Kirk should not be mentioned as such in either patent.
