Summary
The application specified “computer software and computer hardware, all for use in playing games”. The opposition was based on various registrations of CANON in classes 9 and 28, mostly for photographic and photocopying products but including ‘computer software’ and ‘toys and games’. Comparison of the marks, however, (CANON v CANNON FODDER) led the Hearing Officer to the conclusion that there was no likelihood of confusion.
