Summary
Flomat opposed Spiroflows patent under Section 72 as well as Spiroflows proposals to amend under Section 27. The S27 action was stayed pending resolution of the S72 action. Flomat subsequently withdrew both oppositions. Following the usual practice the hearing officer needed to consider whether the withdrawal of the opposition under S72 should be accepted or whether action was necessary in the public interest. He first decided to allow the amendment under S27 which was now unopposed, and then concluded that, with the patent now amended, no further action was required under S72 .
