Summary
The opposition was based on the opponents’ earlier registration of a ‘KROLL’ mark. However, it fell at the first hurdle as the Hearing Officer found that the evidence of use provided in accordance with the requirements of Section 4 of the Trade Marks (Proof of Use etc) Regulations 2004 was insufficient.
The opposition was therefore dismissed with costs awarded to the applicants.
