Summary
The Hearing Officer decided that using a standard scale as a guide when awarding costs in proceedings before the Comptroller did not fetter his discretion under s107(1).
Having considered all the facts of the particular case he concluded that there was no reason to depart significantly from that scale but made a small uplift (£500) from the maximum suggested by the scale in recognition of the unnecessary costs incurred by the Claimants when considering some of Trek’s evidence.
