Summary
The decision considered whether the invention claimed in a divisional application related to the same invention as claimed in the granted parent application. Following similar reasoning to that in Maag Gear Wheel and Machine Co Ltd’s Patent, the hearing officer found that claims 26 to 44 of the divisional related to the same invention as the claims of the parent. He gave the applicants one month to amend to avoid refusal under section 18(5).
