Summary
The hearing concerns whether to exercise the Comptroller-™s discretion to accept further Form 52s to extend the S20 Compliance period on GB 2108146.8 and GB 2108148.4 for the 4th time. The HO decided that the key issue was the reason given for why discretion was being requested balanced against the need to provide certainty for third parties. He concluded that the fact that the applicants were in China and that the cases were somewhat complex were not adequate reasons and so declined to accept the further Form 52s. As neither application was in order at their Compliance date they were both refused under section 20(1).
