The Antarctic Treaty Act 1967 (Channel Islands) Order 1974

Made

Present,

The Queen's Most Excellent Majesty in Council

Her Majesty, in exercise of the powers conferred on Her by section 9 of the Antarctic Treaty Act 1967, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:-

1. This Order may be cited as the Antarctic Treaty Act 1967 (Channel Islands) Order 1974 and shall come into operation on 22nd July 1974.

2. The Interpretation Act 1889 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

3. In this Order the expression "the Channel Islands" means the Bailiwicks of Jersey and Guernsey.

4. The Antarctic Treaty Act 1967 shall extend to the Channel Islands subject to the exceptions and modifications specified in the Schedule to this Order.

SCHEDULEEXCEPTIONS AND MODIFICATIONS IN THE EXTENSION OF THE ANTARCTIC TREATY ACT 1967 TO THE CHANNEL ISLANDS

1. Unless the context otherwise requires, any reference to the Antarctic Treaty Act 1967 shall be construed as a reference to that Act as it has effect in the Bailiwick of Jersey or the Bailiwick of Guernsey, as the case may be.

2. Any reference to a British ship registered in the United Kingdom shall be construed as including a reference to a British ship registered in any of the Channel Islands.

3. In section 4(1), in the case of Jersey, for paragraphs (a) and (b) there shall be substituted the following words:-

"on conviction, to imprisonment for a term not exceeding two years, or to a fine, or to both.".

4. In section 4(2), (3) and (4), in the case of Jersey, the words "on summary conviction" shall be omitted.

5. In section 6(2), in the case of Jersey, the words "respectively" and "paragraphs (a) and (b) of" shall be omitted.

6. Section 6(3) shall be omitted.

7. Section 7(7) shall be omitted.

8. In section 8(1) for the words following "any person" to the end of the subsection, there shall be substituted the words "in the Channel Islands".

9. Section 9 shall be omitted.

10. For section 10(4) there shall be substituted the following provision:-

"(4) Any Order in Council made under this Act, either as it has effect in the United Kingdom or as extended to the Channel Islands, shall have effect in the Bailiwick of Jersey or the Bailiwick of Guernsey, if registered in the Royal Court of Jersey or the Royal Court of Guernsey as the case may be and from the date of such registration.".

EXPLANATORY NOTE

This Order extends to the Channel Islands with exceptions and modifications the provisions of the Antarctic Treaty Act 1967.
