Whereas the Minister for the Civil Service has, under section 65(1) of the Social Security Act 1973, designated the Secretary of State as the Minister of the Crown having responsibility for the pension scheme established under section 26 of the Fire Services Act 1947:
Now, therefore, in exercise of the powers conferred on me by sections 65 and 96 of the said Act of 1973, I hereby make the following Order:-
1. This Order may be cited as the Social Security (Modification of Fire Services Act 1947) Order 1976 and shall come into operation on 1st June 1976.
2. After subsection (2) of section 26 of the Fire Services Act 1947, as amended and extended by any subsequent enactment, (Firemen's Pension Scheme) there shall be inserted the following subsection:-
"(2A) The Scheme may also include-
(a)such provision for the payment of pensions, allowances and gratuities to persons employed as members of fire brigades maintained in pursuance of this Act who are dismissed from such employment, and to their widows, children and dependants, as will enable the Scheme to comply with the requirements set out in Schedule 16 to the Social Security Act 1973, and
(b)such provision incidental or supplementary thereto as appears to the Secretary of State to be expedient.".

This Order modifies the Fire Services Act 1947 so as to authorise the inclusion in the Firemen's Pension Scheme of provisions in conformity with certain requirements of Schedule 16 to the Social Security Act 1973 relating to the preservation of benefit under occupational pension schemes and provisions incidental and supplementary thereto. The relevant requirements are those of paragraph 6 of Schedule 16 (which requires provision for short service benefit where a person's service is terminated in specified circumstances, irrespective of whether it is terminated by retirement or dismissal)
